STUDIO POLICIES AND TERMS & CONDITIONS
Pole Classes include: Pole Flow, Pole Tech, Complete Pole, Beginner 1, Beginner 2, Deep Stretch, and more. These classes can be paid for with Signature Packages, Signature Contracts, or Signature Singles. There are also packages for Beginner 1 & 2 only.
Signature Class Packages – You have the option of buying 1, 3, 5, 10, 15, 20, 50, or 100 classes. Packages of 20 classes or less have a 6 month expiration from the date of purchase. And, packages of 50 or more classes have a 1 year expiration from the date of purchase. The pricing for the different class packages is: 3 Classes – $93, 5 Classes – $145, 10 Classes – $270, 15 Classes – $375, 20 Classes- $460, 50 Classes – $1050, 100 Classes – $1900. Once expired, any unused classes will be lost.
Signature Contracts – You can enter into a 3 month contract, which would bill you for the same amount monthly (for 3 months), and auto-renews after 6 months. Your credit card will be billed at the same time each month, and at this time, your classes will be reset. There are 4 types of contracts: 5 classes/monthly for $90, 10 classes monthly for $160, 15 lasses monthly for $210, and 20 classes monthly for $240. You may take only the amount of classes that your contract allows monthly. Classes do not carry over from month to month. Unused classes will be lost. After the initial 3 month term, you may terminate anytime with 30 days notice.
Introductory and Promotional Deals
Groupon (New Students Only!) – This offer is for students who are new to Dakini. The trial allows for students to take up to 5 classes within four months of the date of purchase through Groupon. Students may use their classes in: Beginner 1 & 2 only.
Payments may be made any time online at www.idakini.com, by calling the studio (732) 667- 7746 during regular business hours or in person. Dakini Movement accepts Visa, Mastercard, Discover, and cash payments. No checks please. In addition, should you wish to sign up for future Dakini Movement classes, you remain obligated to pay any outstanding amounts from prior sessions or classes. All payments are non-refundable and non-transferable.
All class times and teachers are subject to change at the discretion of Dakini Movement LLC.
Should you become injured or ill to the extent that participation in class is not advisable by your physician, you may apply for a Medical Leave of your unused classes toward a future session to be used within one year, provided your class has been paid in full.
For Medical Leave, you must provide a written note from your physician and you must notify the studio no more than 5 hours after your missed class. . Failure to notify Dakini Movement within 5 hours after missing class will forfeit the possibility of a Medical Leave. Any request for a Medical Leave may be granted or denied at Dakini Movement’s sole discretion. A written release from your physician will be required to resume classes.
We do not advise students to take pole classes during pregnancy. Please notify the studio, and discontinue classes if you are pregnant. Your account will be frozen, and you can resume classes upon your return. Payments made prior to the time of notifying the studio of pregnancy are non-refundable and transferable.
Full payment is required to book a Private Lesson.
24-hours advance notice is required to reschedule your Private Lesson.
Non-refundable unless canceled more than 3 days prior to lesson date.
100% payment is required to book a Private Party.
3-days advance notice is required to reschedule your Private Party.
Non-refundable unless canceled more than 3 days prior to party date.
Any and all rescheduling will be at the sole discretion of Dakini Movement and subject to availability.
We strongly encourage you to use all of your classes in a timely manner. We suggest taking class 1-2 times per week. While you are free to start whenever you like, and take classes as often as you like within your timeframe, classes run on a set curriculum, and it is best to be consistent. Please note the expiration date on your Package or Contract. Unused classes will be lost once the expiration date has past.
If you do not cancel, your missed class will count as used even though you did not attend.
Wait List Policy
If you wish to take a class that is already full, login to your account in Dakini’s MindBody Scheduler, and sign up for the wait list. Or, phone the studio and ask to be put on the wait list.
If a space becomes available in the full class, the wait-listed student will receive an email notification stating that space has come available in the class. At this time, please confirm your attendance in the class by logging into your account. If a student confirms, and but does attend, her account will be charged.
Arrival and Departure Times
Please arrive a few minutes prior to your class scheduled start time. First time students should arrive at least 15 minutes prior to the class start time to properly go through the intake process. You may depart at any time once the class has started, but you cannot makeup the class time should you choose to depart early.
Students must be on time for class. Late students can expect to lose their class credit, and/or be turned away from the studio upon late arrival . The studio occasionally does make exceptions for extreme situations, and if the student has a good attendance history. Exceptions will be made solely at the discretion of Dakini Movement LLC.
We have a Five Hour Cancelation window for all regularly scheduled classes. If you sign out at least five hours prior to the class start time, your account will not be charges. Canceling within five hours is called a ‘Late Cancel’, which means that your account will be charged. Parties must cancel no less than 3 days prior noontime on the day of the party. We do not allow cancelations or refunds for purchases of workshops or special events.
Any person who appears intoxicated or otherwise disruptive to the conduct of a class, Private Lesson or Private Party may, at the sole discretion of Dakini Movement LLC, be asked not to participate, forfeiting any deposits and payments made by that person for that class, Private Lesson or Private Party. All pole tricks must be supervised by the instructor, and all inversions must be spotted by the instructor only. Students cannot spot other students. Students who are approved to invert on their own may only do so if the instructor is in the room. If a student refuses to cooperate, or attempts inversions without approval, she will be dismissed.
Code of Conduct
Each student should pre-register for the appropriate class, and arrive on time for her visit. All students must pay attention and participate during the warm up. During class up to three students may share a pole. We expect for each student to be respectful of the instructor, as well as her classmates. Students will only practice the movements that are being instructed. Students are never to attempt to spot or instruct other students. The instructor must be clearly heard at all times. If any one student refuses to cooperate, she will be dismissed.
Attending Classes with Friends
While it is fun to take class with a friend, we highly encourage you to develop your own, individual practice. When booking classes with 1-2 friends, please register at least 1 week in advance to secure space. Do not expect the studio to overcrowd classes so that you can attend with friends. You may take class with up to 2 friends or people you know, as long as there is room in the class, and each of you registers individually. If you would like to take class as part of a group of 4 or more women, please call the studio before registering. We normally do not allow groups of 4 or more women to take class together because we do not want the class to take on a “party-like atmosphere”. Any exceptions will be made solely at the discretion of Dakini Movement. If any one person in the group becomes unruly or disruptive , the entire group will be asked to leave. Groups of 4 or more women who attempt to register without getting the proper permission for the studio may be refused.
Dakini Movement is a private organization whose female clientele seek to celebrate feminine culture in a women-only environment. If you would like to request a male-oriented class experience, please contact the studio for pricing and scheduling details.
Confidentiality and Non-Disclosure
All class content, including but not limited to teaching method, curriculum, discussions, written materials, movements, dance steps, routines, choreography (“Proprietary Information”), are the property of Dakini Movement and constitute confidential and proprietary business information and trade secrets. You agree to keep the Proprietary Information confidential and not to disclose the Proprietary Information to anyone without the prior written consent of Dakini Movement LLC You further expressly agree that you will not use the Proprietary Information for the purpose of soliciting any students or employees of Dakini Movement or to otherwise compete with Dakini Movement.
Release of All Claims (Including Negligence), Hold Harmless and Indemnification
I acknowledge that the activities undertaken in the classes, Private Lessons, Private Parties or any other activity provided by Dakini Movement are hazardous, and I recognize that my participation in the activities is voluntary. I assume all responsibility and risk associated with my participation in any and all activity, program, course or class, and assume all responsibility and liability of physical fitness and capability to perform any and all activity or effort related to and/or associated with the class activities performed by me or which I am involved in. The risks that I am agreeing to assume include the risk that any injury may be caused by physical conditions at the class location or by the negligence of Dakini Movement, its agents, employees, representatives, by me or by other students. I represent that, to the best of my knowledge, I have no medical, physical, mental or emotional health condition which would affect, hinder or prevent my active participation in any classes, Private Lessons, Private Parties or other activities provided or facilitated by Dakini Movement. I acknowledge that I am 18 years of age or older.
I, including my heirs and assigns, to the maximum extent allowed by law, agree to release, give up and forever discharge Dakini Movement and all of their agents, employees, managers, representatives, officers, directors, attorneys, partners, insurers, heirs, predecessors-in-interest, advisors, successors and assigns, including Jeanine Caparoso, (hereinafter, the “Releasees”) from any and all acts of negligence and all other claims and/or demands whatsoever which, I, any third party, or any persons acting on my or their behalf have or may have against any of the Releasees by reason of any accident, illness, injury to or death of any person or persons, or damage to or loss or destruction of any property arising or resulting directly or indirectly from participation in the classes, Private Lessons, Private Parties or other activities (including, but not limited to, any injury or damage occurring while I am on Dakini Movement premises or while using Dakini Movement facilities or equipment in any way) provided or facilitated by Daknin Movement, whether such injury or damage occurs during the participation or at any time subsequent to the participation.
I further agree that, to the maximum extent allowed by law, I shall indemnify, release, and hold harmless the Releasees from any and all claims, losses, illnesses, demands, and injuries to my person or property, foreseen or unforeseen, resulting from, caused by, or related in any way to my participation in and/or presence at any class, program, Private Lesson, Private Party or activity (including, but not limited to, any injury or damage occurring while I am on Dakini Movement premises or while using Dakini Movement facilities or equipment in any way) provided or facilitated by Dakini Movement, including acts of negligence on the part of myself, any of the Releasees or any third party). I agree to indemnify the Releasees, and any of them, to the maximum extend allowed by law, for any cost, expense (including reasonable attorneys’ fees and costs), and loss caused in any way by me. This Hold Harmless Agreement is not in derogation of, but rather supplements, any common law rights to indemnification to which S Factor, its legal representatives, successors and assigns may have. I acknowledge that this Hold Harmless Agreement is binding on and on my successors and assigns.
I hereby acknowledge and affirm that I have read the contents of this Agreement.
I understand its terms, and I knowingly and voluntarily execute this Agreement.
I understand this Release of All Claims (Including Negligence), Hold Harmless and Indemnification Agreement is a release of legal liability, an assumption of risk of hazardous activity and an agreement to indemnify for the acts of myself and others.
I expressly agree that this Release of All Claims (Including Negligence), Hold Harmless and Indemnification Agreement is intended to be as broad and inclusive as is permitted by law and that if any portion of is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Arbitration of Disputes
I acknowledge and agree that the terms outlined herein are contractual. Any and all disputes or claims arising out of or in any way related to this Agreement including, without limitation, fraud in the inducement of this Agreement, or relating to the general validity or enforceability of this Agreement, as well as any claims arising out of my participation in any activity, program, course or class provided by Dakini Movement shall be submitted to final and binding arbitration before an arbitrator of the Somerset County Court System, New Jersey in accordance with the rules of that arbitration service provider governing commercial disputes. The cost of the arbitration shall be split equally by all parties to the arbitration. The prevailing party shall be entitled to reasonable costs and attorneys’ fees. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
Severability, Amendment, Third Party Beneficiaries, Governing Law, Assignment
If any provision of this Agreement is held to be unenforceable, each such unenforceable provision shall be excluded from this Agreement, and the balance of the Agreement shall be interpreted as if each such unenforceable provision were excluded; provided, however, that if a provision is held unenforceable because it is excessively broad or unreasonable as to scope or subject, such provision shall continue to be enforced to the extent necessary to be reasonable under the circumstances and consistent with applicable law while reflecting as closely as possible the intent of the parties as expressed herein. This Agreement may only be modified by a writing signed by an authorized representative of Dakini Movement. The parties hereto intend that this Agreement shall not benefit or create any right or cause of action in or on behalf of any person other than the parties hereto. This Agreement shall be governed by and interpreted in accordance with the laws of the State of New Jersey. The relevant Dakini Movement entity with whom you have contracted may assign any or all of its rights and obligations under this Agreement to any of its related, parent, affiliated or subsidiary entities.
